Welcome to PlatformStay Pty Ltd ("we," "us," or "our"). These Terms and Conditions ("Terms")
govern your access to and use of our Software as a Service (SaaS) application ("Service"). By accessing or
using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Acceptance of Terms
- You are at least 18 years old or have the legal capacity to enter into a contract.
- You agree to comply with these Terms and all applicable laws and regulations.
- You accept our Privacy Policy (available at https://platformstay.com).
2. Description of Service
The Service is a cloud-based software platform provided on a subscription basis, accessible via the internet.
We may update, modify, or discontinue features of the Service at our discretion, with or without notice,
provided such changes do not materially reduce the functionality of the Service during your subscription
term.
3. Account Registration and Use
3.1 Account Creation
- You must provide accurate and complete information to create an account.
- You are responsible for maintaining the confidentiality of your credentials.
- You must notify us immediately of any unauthorized use of your account.
3.2 Use Restrictions
- Do not use the Service for any illegal or unauthorized purpose.
- Do not reverse engineer or attempt to extract the source code.
- Do not share your credentials or allow unauthorized access.
- Do not upload or transmit any harmful or malicious content.
4. Subscription and Payment
4.1 Subscription Plans
The Service is offered on a subscription basis, with fees and terms outlined during registration or on our
website. Subscriptions may renew automatically unless canceled as per Section 4.3.
4.2 Payment
- You agree to pay all applicable fees for your subscription plan.
- Payments are processed securely via third-party providers.
- All fees are in AUD and include GST unless stated otherwise.
4.3 Cancellation and Refunds
- You may cancel your subscription anytime via your account or by contacting us at info@platformstay.com.
- No refunds for partial periods unless required by Australian Consumer Law.
- If we terminate your access without your breach, you may be eligible for a pro-rata refund.
5. Intellectual Property
Our IP: The Service and its components are owned by or licensed to us, protected under
Australian and international laws.
Your Content: You retain ownership of content you upload ("User Content"). By uploading it,
you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process it to provide the
Service. You are responsible for ensuring your content is lawful and non-infringing.
6. Australian Consumer Law
As an Australian consumer, you are entitled to guarantees under the ACL. Our Service must be:
- Provided with due care and skill
- Fit for any disclosed purpose
- Delivered within a reasonable time

7. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for indirect or incidental damages such as lost profits or data.
- Our total liability is limited to the amount you paid in the 3 months prior to your claim.
- We do not exclude liability for guarantees under Australian law.
8. Termination
- By You: You can cancel your account anytime and stop using the Service.
- By Us: We may suspend or terminate your access if you breach these Terms or pose
legal/security risks.
- Upon termination, your access ceases and we may delete your data after a reasonable time, subject to
legal obligations.
9. Governing Law and Jurisdiction
These Terms are governed by the laws of Queensland, Australia. Any disputes will be handled exclusively in
the courts of Queensland.
10. Changes to These Terms
We may update these Terms from time to time. You’ll be notified via our website or the Service. Continued use
after changes means you accept the updated Terms.

- Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement
between you and us.
- Severability: If a clause is found invalid, the rest remain in effect.
- No Waiver: Failure to enforce any part of these Terms is not a waiver of our rights.
